2) Ferno Canada for Part B in the amount of $39,206.80 excluding HST.
3) Medical Pharmacies Group Limited for Part C, D and G in the amount of $186,930.80 excluding HST.
4) Allied Medical Instruments for Part E in the amount of $849,422.63 excluding HST.

Notice of No Bid from Rutherford - 11/7/22 - forwarded to Caterina
I am responding to your inquiry as to the reason for our No Bid.
We are very interested in work of this nature and we were completely prepared to close the bid until the final Addendum was issued requiring us to assume the role of “Constructor” for a second General Contractor in the space, not a sub-contractor of ours for a scope and duration of work unknown to us.
This would have had us in a position of significant risk for Orders and potentially fines issued by the Ministry of Labour to our staff and Company Directors for workers not under our contract, control or direction by our Supervisory staff. This would also require us to have a Competent Site Supervisor on site during periods of time when our workers were not on site overseeing the Other Contractors workers who are not known to us as “competent” as defined by OHSA.
Secondly if the other Contractors forces were to work on the site unknown to us and have a MOL Inspector visit the site or an incident/accident happen being the “Constructor” as per the Form 1000, we again are at risk of Orders and fines.
When analysing the significant risk of assuming the “Constructor” role being downloaded on to us contractually for a project we were bidding of a much lesser value than the other Contractor’s project, our Senior Management decided the risk far out weighed the potential gain. We decided not to bid despite being ready to submit.
At Rutherford Safety is a high priority focuses. We have been presented with awards form the OGCA and recognized by IHSA for being an early adopter of CoR despite the size of our organization. Assuming the unknown high risk of a safety incident by another company on our record is contrary to our commitment to our people and organization.
We would be glad to meet with your management to discuss how this situation could be managed differently with similar site conditions in the future. We ask to be included in future bid opportunities.
