BRIEF DESCRIPTION OF WORK - Ontario’s new Regulation 406/19 for on-site and excess soil management (the “Regulation”) is now in effect. The Regulation is phased as follows:

• Phase 1 - in force now and sets out reuse rules, new soil quality standards, waste designations and approvals
• Phase 2 - in force January 1, 2022 and adds requirements for planning, digital tracking of soil loads and registration (exemption where grandfathered or project is described in Schedule 2 of the Regulation)
• Phase 3 - in force January 1, 2025 and adds restrictions on landfilling excess soil
• Phase 4 - grandfathering for Phase 2 requirements ends January 1, 2026 and must have a contract for soil management in place by January 1, 2022.

The Regulation applies to on-site management of soil and excess soil moving off of or being brought onto the project area or part of the project area. As the owner of the source site and project leader, the Region must ensure due diligence is carried out and that all requirements are met to ensure compliance with the Regulation.

This Request for Pre-Qualification (RFPQ) is open to all Respondents who wish to be pre-qualified to provide Qualified Person services for the Region’s Environmental Services capital projects. 

Stage I:            Request for Pre-Qualification of consultants/subconsultants

The objective of Stage I (the “pre-qualification stage”) is to obtain and evaluate relevant information from interested Respondents to establish a roster of Selected Respondents who will (i) be invited to submit competitive bids in response to subsequent RFQs for the Services issued during the Roster Validity Period, or (ii) be able to be selected as a subconsultant to perform the Services in subsequent RFPs issued during the Roster Validity Period. Only those Respondents who have (i) achieved a minimum overall score of 60% and (ii) scored a minimum of 15 points for each Qualified Person’s experience under Sections 5.2.3 and 5.3 of the RFPQ, shall be deemed to be a Selected Respondent invited to participate in Stage II. Refer to Section 6 - SELECTION PROCESS for additional details.

Stage II:           Request for Quotations (RFQs) inviting bids from the Selected Respondents to provide the Services, or Request for Proposals (RFPs) inviting proposals from firms who will be required to choose a Selected Respondent to perform the Services 

In the case of RFQs, the Region will invite all Selected Respondents to submit a bid in response to RFQs for the Services. The Region will issue RFQs for the Services on an as needed basis. 

In the case of RFPs, all Selected Respondents will be listed as subconsultants pre-qualified to perform the Services on selected RFPs.  The Region does not guarantee that firms submitting a proposal in response to the RFPs will contact all Selected Respondents.
